Licences can be transferred of course, it's required by EU laws.
In case of AmigaOS 4.x I think the seller has to delete his registration on the Hyperion web site first, making the serial number available again for re-registration by the buyer.

AmigaOS 4.x developers, and maybe beta testers as well (not sure), didn't have to buy AmigaOS 4.x licences but had access to the beta server with all versions and updates for free.
For example I never had an AmigaOS 4.x licence for my A4000, AmigaOne XE nor Sam440ep machines, I only have one for my X5000 which I got after quitting the OS4 team.
