In the settlement between Hyperion and Amiga Inc there is a clause that effectively forbids Amiga Inc from using or granting the Amiga name for use for computers that have an OS similar to AmigaOS4. HyperionMP expressed that he felt that a Commodore USA Amiga would be in breach of this clause and he would consult with his legal counsel. As far as we know, no action has been taken and it is not definite that any will.

It is up to Hyperions's lawyer to investigate whether or not any action should be taken.

Yes, its not OK they did it without at least letting Hyperion/A-EON/Acube knowing about it,
but then again how have I never seen that clause

Please, some link or so.

However, these machines will not use, "similar OS" at all.

My point of argue,(not legal reasons) would be:

- Abuse of Amiga name just about time new boards were supposed to be launched, creating confusion with AmigaOne brand, even both trademarks are separated

'- Amiga Inc first time granting Amiga name to anyone for hardware (beyond Eyetech). It would be fairer in light of AmigaOS 4 development if it was granted to e.g. Acube creating Amiga 460 or AmigaSAM line. Meanwhile, last sound promise of AmigaInc delivering AMigaOS 4.x compatibile hardware (at the time of dispute) both low end and high end remains undelivered promise, as well as AmigaOS 4.x software Amiga Inc promised with Cloanto, Matrox GFX drivers promised in strategic alliance with Matrox ... too bad we can`t sue companies for false advertising leading them to lose the trademarks and copyrights they abuse.

- Commodore USA false policy of presenting Intel based machines and pretending them to be AmigaOS 3 compatibile, with using dual boot AROS (without much support to AROS development) and WinUAE without KS files (both avail free) pretending to be making "new Amiga" and commercializing it so, with Amiga 1000 pictures and Commodore name, making people believe that is Amiga, trying to jump over the AmigaOS 4 hardware and software.

I believe they have legal rights derived from Amiga Inc to have this kind of computer, but it is sooo big lie.

I e-mailed them with simple request could they just include info on existance of OS 4 with tha machine, and got no answer at all.

But yet its seems like much better design then their Phonenix, and yet it is unknown how their "Amiga" will look like ...

False advertasing, drawing as many as Amiga concepts to non Amiga computer ...

This new Commodore should be burned down as Amiga is concerned If they would make a CBM 128 redesign with ability to boot to emulated CBM 128 and Win/Linux ...

Hell, their OS list is bunch of promises also ...

Web design is like crappy private web site.

Acube and Hyperion look like spaceships compared in delivery and style ... and yet some people on AW.Net support such crap

I'm late to the discussion, but thought I'd throw 2 cents in.... Maaaany years ago I taked with some one on the Aros team about joining the effort. Wether my memory it correct or not, I believed the project to have been started and based on Commodore's published public documents... the Rom Kernel Reference Manuals (Still have my set). They detail the API's of 3.x and I guess are considered "open".

You can probably also still find the posts on Amiga.org where the same manuals are referenced in creating the Minimig project too.

Now, they announced 30 million campaign (nice for them, just waiting to see how they will raise and refund that money), started using couple AW members to promote it, and told AROS dudes they will not developed AROS or give them any contribs

Yeah, we kind of hashed alot of that over at AW.org already. If they have the cash, they can try to do just about any thing they want. Will it be profitable enough to support all the effort remains to be seen. When was the last time a partner of Amiga Inc fared well? Could the same fate await C=USA?

I'm not totally against what their doing. But I would also like them to acknowlege other AmigaOS efforts that are going on now.

I can understand them holding back info, I can understand them avoiding players like Hyperion, Aros and others based on past and recent troubles. What I don't understand is their motivation, timing and method in approaching the classic users and sites.

BigBen whom I would trust, is saying there will be net gain for the community. But Barry's writtings and other spectulations are not making a good selling point.

We also have not heard the last word from Hyperion. I can imagine great things, or I can imagine great distress. All the peices to the game are not yet on the table.

Yup, what I have just posted to AW.net is that I have learned that not only their Amiga name buyout was Amiga Inc last zombie move (with the question were they operational company at the time), but also that their Commodore name is dubious too

So, its speaks much about them.

What I feel said is the ability to approach and trick a lot of people, why generally they are just hardware vendor and are not willing and able to improve x86 AmigaOS (which is only AROS).

Attemps to penetrate existing Amiga community are kind of "reality hits" but they actually have nothing to offer to have new reality.

And when you read their press realise, its still full of AROS, community and future, while their product is yet to be seen

Their original bigOS scheme included ChromeOS, WinUAE, AROS ... even something called "Comodo" and now is down to Linux

They generated a lot of hits by simply having the proper combination of names that rings the bell.

But one most love dubious sentence on their web site that shows how their name generates confusion

All Commodore and Amiga computers fully support Ubuntu and Windows operating systems.

Lets just wait for november, for which our "x86 Amigans" say will bring more info, but I expect some A1200 recreated case and Atom based PC. Nothing much.

This is true in perhaps a way you didn't consider. C=USA is now paying them licensing fees. A.Inc may also be working deals with others. This may give them the ability to become more active. In a sense it may be their last zombie move, because they may not be a zombie any longer.

We don`t know was it a single paid contract (probably used to refund the Amiga Inc losses) or is it based on sales (per computer) where Amiga Inc fate is tied to CBM USA.
What I dislike in Amiga.org case is that CBM USA started to behave like they own the old CBM Amiga logo universally not only for a computer.
Also, it seems for AmigaInc licencing the name (existed long time on web site) was matter of money, not issuing to as many clients as possible, as I understand Acube tried it and failed. So my guess is not too many "victims" they will find, and as with X1000, we can use AmigaOne name for our hardware.

Having both Commodore and Amiga name gives them a great adventage, but will see how they will do and what price they will set.

Only gain real Amiga community can have is from those dissapointed users or users willing to search for real AmigaOS developments.

Dropping AROS (even all their announcements count on it) is also a strange thing, but best to my knowledge they compete with AresOne which has a very nice software setup and is able to better emulate Amiga Classic out of box.

If they reach higher price then similarly built AresOne (while underpowered since they use Atom and integrated gfx) then it`s our duty to promote AresOne against it, since it benefits AROS and they are not about to . I doubt they will create better software bundle.

They may also "come out of closet" in November, together with EP460 so it will be interesting - we`ll be speaking of our new toy, and imagine their campaign will be even more agresive.

I believe X1000 will wait next year, but A-EON were supposed to get this kind of "new Amiga" attention,
so they basically "stole the momentum".

It seems they want all the customers they can get, so they don`t have troubles in having couple of x86 trolls

In pointing out the problems they had with Commodore name and moment of purchase of Amiga Inc, I believe they have sorted it out by now before launch, but I wanted to point out that they have not contacted anyone dealing with similar products or using similar names, so it was a real "hidden strike" for everyone.

My best bet is as they call as small retro nostalgia community they will soon discover PC users out there will not buy their computers just for nostalgia name, once discovering that is what they already have.

It seems no case was taken (CBM USA claims so, Hyperion is silent) so this is state of affairs - Hyperion owns AmigaOne name and CBM USA Commodore Amiga name.

However, OS.news just mentioned that Hyperion will take legal action (or may take it) and that it looks like hoax was also threatened

It`s good they have not removed it, but it seems once "Commodore Amiga" is out again, they could change it.

Midst of the confusion they are creating is now my signature at aw.net which sounds dubious to everyone that ever had Commodore 64/128 or Commodore Amiga
