According to Amiga Inc., it's the 25K of their contract, which they are ILLEGALLY trying to acquire for that amount, trying to by-pass the fact that they have to pay for the "work done" to date, of actually MAKING the OS, which is in the order of $2 mil. (The contract states, in no uncertain terms, that all else has to be paid for, before that part of the contract can be excersized. They can't just pick and choose what they'll pay for.)


However; I contend that Hyperion really, having taken the burden of developing it, having actually INVESTED in it's production, is entitiled to "investor" status, and therefore 50% of derived profits.

Amiga Inc. made it possible (in the first place) for Hyperion to have the right to develop it, having acquired the rights to do so from Gateway 2000, in Dec. 1999. Amiga Inc. have the right to make money off of AOS4.0 sales, I have no complaints on this issue. Fair is fair.



Sooooo, what is the worth of AOS4.x?


Well, Commodore Amiga sold in the neighborhood of 7 million Amigas.....
So, that COULD be attained again, meaning that, 7 million * $100 per AOS4.x CD = $700 million dollars, half going to Hyperion. This is CASH. Meaning that, this being incorporated into the price of an (micro)Amiga(One) is the full amout received, and there is no "dealer cut" on this.

That is, Hyperion would get $350 million and then government taxes kick in and whatever is left stays with them.


So, Hyperion, "Fight the good fight" and go git 'em!!!!!

How can you say "illegally" when the judge still has to decide on all this? The judge will decide what was legal and what is illegal, not you, so maybe you shouldn't state it as a fact.
If you talk about legal or illegal, you need to drop the moral feelings of right or wrong, it doesn't work this way. It's economy, not charity business.

It's difficult to say, but it's clear that it will be worth much less after a long court trial. If they include the lawyer payments in their profit calcualtions for OS4, I hardly believe there will be anything left.
