New Filing at Justia

There has been a new filing in the Amiga v Hyperion case. I have found at least one typo in the new filing (page 3, lines 15 through 18, as the referenced paragraph didn't really contain any allegations. They must have meant paragraph 24, as there are allegations there). As regards paragraph 62 and the statements it makes regarding paragraph 62 of the amended counterclaim, paragraph 62 of the amended counterclaim contains a typo: there is a rather important word missing. The filing concludes by demanding dismissal of the amended counterclaims, asking for lawyers' fees and court costs. While it does not preclude them, it does not ask for any other damages regarding the amended counterclaim. It is requested that those replying in this thread at least try to park their bias at the door.

I forget, was it Hyperion or Eyetech that originally got this whole A1/AOS4 thing together?
No, no, no,! Let me correct myself. That was Amiga, Inc. who licensed the hardware development to Eyetech (after which Mai Logic went belly up, suspending that development and production) and the development of the OS to Hyperion and was prepared to license more hardware once a final version OS was released. But then you run into the problem of someone refusing to release a final version OS until they were threatened with court proceedings.
Without Amiga, Inc. none of you would even have A1's or AOS4 in any version.

@Swoop
I said zero about anyone out to get me.
Get the unadulterated IRC log for the show from AW.net, search it thoroughly, and you will find users suggesting that a gun should be mailed to Bill McEwen with instructions that he should use it on himself.
Tell me that is not a threat on his life! Tell me how that is balanced!
Rogue, While I admire the coding that y'all have done (and I have prayed for your family, don't forget), I don't give a rip who you say owns IP.

@Swoop
So I guess it's perfectly OK to threaten someone's life so long as you think they caused you some delay in your instant gratification of new hardware, right? I guess it's perfectly OK to hammer, hammer, hammer, hammer at the one YOU want to hold responsible even though there's NO evidence that they actually are responsible, right?
Oh! That's just so balanced of you! NOT!!!

@AmiGame
It was directly against God. That way he gets to insult everyone of all faiths with one hammer.
I, too, like the way Yahoo handled the article. I could see the tongue-in-cheek way they did it, and had to smile at that. However, as I noted earlier, I had other sources that went into more detail then Yahoo did.
No matter what he said to Yahoo, he is not simply trying to make a point. Such a thing could easily have been done without insulting 90% of the populace in the process (get together with a knowing accomplice and sue them for spilling water on you, etc). He, however, went out of his way to add insult to point.

@goody
You see, that's the problem with a lot of people. They don't understand a person's post, so they assume that that person doesn't know what's going on.
I did read the linked article. I also had other sources on the story. The man is a state legislator in Nebraska, who claims to be an atheist. So you have an atheist (who therefore does not think God even exists) who is nonetheless suing God. If he actually is an atheist, then he is wasting public funds suing someone who doesn't exist (in his opinion), and is highly insulting the majority of his own constituents (the majority of which would claim to be Christian, therefore believing that God does indeed exist). So, he is insulting the intelligence of his constituents while blatantly wasting their tax dollars and the government's time with this showboating insult of all people of faith.
He needs to be removed from office, and when his next election comes around, I somehow doubt that he will win after pulling a stunt like this.

@Mikey_C
To top it all off, the plaintiff claims to be an atheist. So, if he is an atheist, who is he suing?
In my own opinion the guy (member of the Nebraska state legislature) ought to be removed from office because of an obviously frivolous lawsuit that is only intended to insult people of faith.

@All
So, why is it that we must blame Amiga, Inc. again? Is it because they own the IP and actually want to paid for it? Sure, Amiga Inc. filed the lawsuit, but it is Hyperion who were refusing to release a final product (even tacking stuff on from the 4.1, 4.x, etc. feature lists in order to keep going without releasing a final product) until Amiga, Inc. confronted Hyperion with Hyperion?s actions and gave notice that the contract was null and void because of Hyperion's actions. Why does the owner of the IP get blamed while the company that held it hostage for all these years gets to skate? There?s plenty of blame to go around for everybody involved, so try to be a little bit balanced.
EDIT: I mean come on! I was just on the IRC channel and people are suggesting that a gun be mailed to Bill McEwen with a note suggesting that he use it on himself! This goes entirely too far! Bill McEwen is not to blame, and even if he was, such actions would constitute felony offenses in most countries!
Balance yourselves! Please!

I have just ordered this camera from newegg, and it seems to have a rather odd aspect ratio?at least it?s odd in the USA. I can?t comment on other regions, of course. My reason for buying it is that my old camera just yesterday came up with dark spots all over the photo I took of some leaves, and at the same time, I got my ad from newegg. The ad had this camera in it.

@Atheist Well, I logged into the IRC channel and found a link that led me to think that it was available, but that link is misleading, the actual page turns out to be this. Kind of cruel if you ask me.

Mikey,
Let's hope they don't try that. It would only complicate matters further. As hard as it is to do, let's wait for the judge to decide rather than risk infuriating him by jumping the gun on anything related to this case.

A coworker/tech of mine told me about the capability of Compact Flash cards to attach (through an appropriate adapter) to an IDE bus so that a computer can be booted from the compact flash card. Now, I'm sure that someone has already done this on A1's but my question is does this work with ATA and/or SATA as well, or only with IDE?

Hyperion has asked the court to issue a 60 day summons against Itec, LLC, whatever the 60 day part means.

There's nothing new there. It's just reworked to include Itec LLC.

@Kreciu There is nothing in that report stating that the corporate entity of eBay/Paypal corporately supports Planned Parenthood?as a corporation, through corporate donations?but only that they allow their employees and customers to support who they want to support. Quote: eBay Inc. and the eBay Foundation support a wide range of charitable-giving activities on behalf of eBay and PayPal employees. The eBay Foundation is dedicated to administering these programs with a democratic approach that ensures employees are empowered and enabled to truly champion the charities that matter most to them, including Planned Parenthood. For me, the question is: Does ebay/Paypal support Planned Parenthood through corporate donations, or are they simply allowing their employees to support Planned Parenthood? It?s a difference between supporting infant murder themselves, and simply allowing their employees to support who their employees want to support. One cannot expect secular persons and/or organizations to exhibit Christian discernment because it is simply not in them to be able to do so. One wonders how many Christian organizations are among the 13,000 501(c)(3)'s that utilize the eBay programs. Or aren?t you interested in that? By the way, without the LDI claims there would have been no tamebay report, so it?s still the same source.
