hyperion posted their counterclaim, and amiga are responding to it. i dont think kinsel will reply again to it.

point 1 - if hyperion dont own the trademarks, how can they sue amiga for not owning them?

point 2 - if hyperion want to persue the 2001 contract section 2.07, and quote it themselves, they must then be bound by what it says, and it says the amigaone partners get stuff in case of bankruptcy, not just hyperion. they need to join eyetech in the case to get things for the amigaone partners in the contract.

the rest is just variations of this really.

and there's me thinking that Hyperion should pay their own bills to make what they were contracted to do, silly me!

are you seriously trying to make me believe that even with the contract, Hyperion are allowed to charge Amiga Inc all the development costs? if that is to believed why have there only been a few full time developers over the past 5 years? why didnt they get a whole team of full time developers and have this all done in the correct timeframe they agreed on in the contract?

also, are you telling me that hyperion never agreed to the $25000 fee? even though it *is* in both contracts they signed? what about the ITEC contract then, can you tell me how that isnt a complete purchase of everything Hyperion have on OS4?

just because you dont like it, doesnt make it untrue.

hyperion asked for $25000, in both the 2001 contract, and the 2003 contract with ITEC, so therefore we should assume that they want $25000, not over 2 million, yea?

Europe will only get more backwards compatible consoles if they find a batch somewhere. they will not make any more. rumours are that in a few years they will have finished their software ps2 emulator and have that as a firmware update, just like the ps1 emulator now.

The PS3 version of the orange box is not as good as the 360 version, which again is not as good as the PC version. Valve would not touch the PS3 with a very long pole, so EA had some of the in-house guys do it with help from valve.

Portal has become something of a phenomenon, but the story of half-life 2 brings me back for more. can't wait for ep 3!

windows equivalent http://www.hdtune.com/ although it has health check stuff as well.

Hyperion have always been able to do whatever they wanted. all thats happened is that they have not been told to stop *now*. The court case is ongoing, and if amiga.inc win, then they will claim damages if hyperion sell anything, especially to what they were never entitled with in the original contract.

Realise that these are companies, and what you are promoting is the same as when certain community members promoted AmigaDE + games + SDKs. look at the laughing stock that became.

i think the ideal thing is for amiga.inc to get back everything, and then sell it to someone who gives a crap :) someone new who hasnt been tainted by the amiga markets.
