@Severin
Happy B-Day -- and many more to come -- to a nice site! The year did indeed go quick.
As has been mentioned before, hopefully in the upcoming year we'll finally see some kind of positive resolution to the AInc./Hyperion mess. Not holding my breath but we can always hope.
Kind Regards, Kay

Hmm, it seems that Hyperion have decided to play rough. Somebody mentioned (asked) if the 2 lawsuits would be combined. My understanding is that is what usually happens, but I don't think it has to necessarily be the case. I think it requires the consent of both parties. In this instance, it may be to Hyperion's advantage to have separate trials; Amiga Inc has requested a jury trial, and their lawyers seemed to emphasize emotional arguments, but without a great deal of actual substance. Hyperion's lawyer stressed the actual legalities (non-emotionally), and that was correct in front of a judge. I think they have a better opportunity if they have individual trials, with their lawsuit being heard only by a judge.
..... It is so sad to it come to this, with no real solution in sight.
Regards, Don Feldbruegge
I have to admit I'm a bit surprised by the extent of Hyperion's counter suit. It should never have gotten to this point -- this lawsuit should have happened years ago, but both companies let things slide for whatever reason. AInc was happy to let Hyperion continue developing the OS far past original specs (at Hyperion's expense), thinking they would get all the source code without a quibble (which they should have if payments had been documented properly on both sides). And Hyperion was happy to go along with all the asset transfers and company changes, thinking they would end up with full OS ownership because of those possibly illegal transfers. Both companies have screwed up royally in letting this go on because no outcome is really certain. Now it will be very interesting to see what AInc comes up with as a reply to the counter suit. All the transfer documents for a start. I do hope for a settlement. Kind Regards, Kay

But then again, we really don't know how often Orgin bangs his head against doors now do we...
Rather often lately
Ouch! I don't get into the forums every day so I obviously missed this story. Hhmmm... I sometimes feel like I'm banging my head against a brick wall, does a door give better results? Kay

@Mitch Mitch wrote: hatchi over on amigaworld.net has somehow got hold of the judges decision on the injunction. The result is Amiga Inc has NOT got its preliminary injunction and will need to decide whether or not it wants to proceed to full trial. Thanks for this. Geez, they're all crazy to want this to go to a full juried trial. Can you imagine trying to explain this mess to a bunch of clueless people? All the seemingly shady dealings would come out in the open, on both sides, they have to realize this. I wouldn't think AInc could really afford that with the goofy Kent deal going on -- they're already being watched. I suspect AInc would go for the sympathy vote, which is what it sounded like they were trying to do with the judge. I certainly hope the judge's decision pushes them into thinking arbitration might be their best bet after all. We need more popcorn here... Kay

So, where are the new computers?
New Amigas? Hung up in yet another court case. What are the odds that we'll see them some time this year? Very low is my guess. Kind Regards, Kay

@Raziel Like a lot of us I have software I need to use that is written for Windows only. I need financial, business, production software as well as the fun, artistic stuff. I also do a lot of research using the internet and it got to the point where at least a quarter of the web sites I wanted to get into were not viewable with Miggy. But even at that I used it as my only computer for a long time. I don't remember what version of Windows we were using where I worked at the time, but I sure didn't want to use it at home too... But Windows got better. Eventually. Now I'm using XP Pro. When I sold my A2000 and got an A4000 ('94, '95-ish?) I had planned on doing a lot of upgrades and getting it current for the times (for the Amiga). Unfortunately, job changes and reduced income put the skids to that idea. If I could have upgraded my miggy no doubt I would still be using it for some of the work I need to do. Now it would be next to impossible, not to mention prohibitively expensive even if the hardware could be found. Amigas are so fun and easy to use I hated putting mine away. I've been trying to keep up with Amiga developments over the years, hoping for a new system, and now we're landed in this newest legal mess. Is it ever gonna end?? Kind Regards, Kay

@Mikey_C Howdy Folks! I don't know if I'm #500 or not but after having been lurking for quite a while I decided to finally register. This is a nice site and I'm glad to be here... Kind Regards, Kay PS: As far as Amigas go my poor old girl is hiding under my bed (bog std. A4000). I got to the point where it just couldn't do what I needed so she's been taking a long rest. I'm hanging out like everyone else, waiting to see the next drama in this continuing saga we're all involved in. I had really hoped to see new machines, but...
